1) OVERVIEW

This Privacy Policy applies to you and your use of our Website which is owned and offered by HMS Technology, Inc (HMS, we, our, or us). By using our Website (other than to read the Privacy Policy or a revision to the Privacy Policy for the first time), you acknowledge that you have read, fully understand, agree to, and agree to comply with all of the terms and conditions stated herein. If you do not agree with and accept these terms, you are not allowed to use our Website.

HMS reserves the right to change the Privacy Policy from time to time and will post a new revision date at the top of the Privacy Policy each time a change is made. You should check the revision date each time that you use the Website and review the Privacy Policy to see if a revision has been made since your last visit. The posted Privacy Policy is binding on you at the time you use the Website and you must not use the Website if  you disagree with the Privacy Policy posted at the time of your visit. The Internet is an amazing tool, but it also has a downside when it’s used for the wrong reasons, especially when a person’s privacy is violated. It’s HMS’s policy to protect your privacy and at the same time improve your experience when using the Website.

To protect your privacy, we follow these two primary principles in accordance with worldwide practices for user privacy and data protection.

  • We will not disclose your “Personal Information” (e.g. name, home address, phone number, email address) to any person or entity.
  • We use state-of-the-art security measures to protect your Personal Information from unauthorized users.

2.0 DEFINITONS

2.1 HMS

This means the corporation known as HMS Technology, Inc (HMS) and any person or entity that is involved with ownership, management or operation of HMS, including: associates, companies, employees, management, staff, consultants, corporate directors and corporate officers.

2.2 Website

This means HMS’s online Website located at www.hms-technology.com and all associated services and content provided, downloaded, or made available when using the Website. This includes; messaging tools, software dashboards, software products, information, and AI powered tools that can be used by our Clients to manage their business and provide their own phone answering service.

2.3 Client

This means any person or entity (e.g. business, school, organization) that; 1) buys our products or 2) tries-out or subscribes to the services offered on our Website.

2.4 Caller

This means any person or entity that calls into an answering service provided by our Clients.

2.5 Guest

This means any person or entity that visits our Website and is not a Client or Caller.

2.6  Users

This means any person or entity that visits our Website (i.e. Guests, Clients or Callers).

2.7 Proprietary Information

This means all documents and information that is owned or licensed by HMS and displayed or offered on or through our Website, including: graphics, pictures, text, menus, forms, controls, features, widgets, documents, plug-ins, toolbars, operational features, product listings, website design, slogans and Copyrighted Material.

Copyrighted Material is artistic work or other material that is currently owned or licensed by a person or entity, including; slide presentations, videos, pictures, writing, trademarks, books, ads, maps, dramatic works, photographs, lyrics, music, sound recordings, software and website designs.

2.8 Personal Information

This means any information that has been provided by a User to HMS in confidence and is not available as Public Information. Some examples include: date of birth, home address, email address and social security number.

2.9 Public Information

This means any non Proprietary Material and non Personal Information that can be found in the public areas of the Website, including: entries made in the comment sections or forums. In addition, this includes any related information that can be found in other public venues or outlets, including: broadcast outlets and media, print media and social websites.

2.10 Communication Platform

This means the tools and services provided as a part of the Website to assist Users in communicating with HMS or each other, including: bulletin boards, chat areas, forums, comment fields, collaboration fields, and personal profile fields.

2.11 Communication Material

This refers to the information used for communicating with Users and HMS on the Communication Platform, including; messages, chat transcripts, discussions and comments.

3) NOTICE TO PARENTS & GUARDIANS

We want to help you guard your children’s privacy and encourage you to talk to your children about safe and responsible use of their Personal Information while using the Internet.

We restrict the use of our Website to people that are at least 18 years old and we do not solicit to or intentionally collect information from anyone under the age of 18.

4) USE OF COOKIES

While you are using our Website, HMS and designated third parties may use Cookies to automatically collect information from your browser, including; your IP address, your browser type and language, your access times, your actions, the content of any undeleted cookies that your browser previously accepted from us, the referring website address, and subsequent websites that you might visit. This data is generally used as feedback to determine if we are providing adequate service, identify areas that need improvement, and to comply with advertising and affiliate marketing agreements. Most browsers automatically accept cookies, but you can usually adjust your browser setting to decline cookies if you choose. If you decline cookies, you may not be happy with the way the Website operates.

If you click on an HMS link that takes you to another website, you begin operating under a different Privacy Policy and we have no control of how other websites collect or use your data. We highly recommend that you review the Privacy Policy of any website that you visit

5) WEBSITE ACCESS

In order to gain full access to the Website, we may ask you to complete a Captcha quiz and/or submit and verify your email address. These steps are taken in order to protect the Website from cyber robots attempting to collect information or harm the Website and/or its users.

HMS is based and operates in the United States of America. Our Website is primarily intended for use in the United States, but may be accessed from other locations in the world. If you access our Website from another country, your information may be transferred to and processed in the United States.

6) EMAIL & TEXT CORRESPONDANCE

We may send text messages and emails to you for a number of reasons, including; reset a password, respond to your questions and keep you informed about new projects and events. Opt-in check boxes or links are provided to allow you to choose the types of emails you would and would not like to receive. All Opt-in check boxes are left blank by default, therefore you will need to check each box first before you can receive the associated correspondence.  

7) PERSONAL INFORMATION

We take strong measures to protect the security of your Personal Information from loss, misuse, unauthorized access or disclosure, alteration, and destruction, including;

  • Encryption of stored data
  • Access controls for employees
  • System monitoring and audits

However, no system can be completely secure from cyber attacks and we cannot guarantee that your Personal Information will be completely secure. You should be very careful about the type of data disclosed on our Website and other websites.

HMS provides AI Powered Tools for Clients to use as an answering service for Callers. Both HMS and Clients may receive, record, store and process information received during the calls (e.g. names, phone numbers, email address, messages shared during the calls). HMS treats this type of information in accordance with the Privacy Policy stated herein. However, Clients have their own Privacy Policies and Callers need to also review the Client’s Privacy Policies in order to get a complete understanding of how their information is protected. HMS has no control over any Client’s Privacy Policies and therefore Caller agrees that HMS cannot and shall not be held liable for any issue related to the protection of Caller information by Clients.

Call transcripts are typically provided by Clients to Callers, on an ongoing basis, as part of the Client’s service. Callers can work directly with Clients, on an as required basis, to answer questions and obtain missing or additional information received during the calls.

9) DATA RETENTION

We keep personal information only as long as necessary.

  • Client account data is deleted 30 days after an account is closed.
  • Caller information is generally stored until the Client deletes it or asks us to delete it.
  • Marketing contact information is kept until a Client unsubscribes or when it is no longer needed.

When data is no longer needed, we securely delete or anonymize it.

10) PUBLIC INFORMATION

Our Website provides Communication Platforms that allows you to send and receive Communication Material and use other related features for posting comments, communicating with other Users and providing social media content. Once posted, your Personal Information becomes Public Information and you have no privacy rights with respect to the posted information. Public Information can be viewed, collected, and used by others at their discretion. Always use caution and good judgment when posting Personal Information. 

11) ENFORCEMENT

If you believe that someone has violated your privacy or that we have not adhered to the principles outlined in this Privacy Policy, please notify us by email at [email protected] and we will promptly investigate and correct the problem. To help ensure quick service, please use the words Privacy Policy in the Subject line of your email.

12) THIRD PARTY COMPANIES

We occasionally hire third party companies to provide services on our behalf, including answering questions about purchased products or services, processing payments, developing new ideas and reviewing projects details. We are very careful about picking the companies that we work with and we only provide these companies with the information they need to deliver the specified services.

13) INFORMATION DISCLOSURE

We will not disclose your Private Information to any third party without your consent except when required as part of our business process or under exceptional circumstances, such as.
